UmbaIA terms of use

1. WHAT UMBAIA IS

UmbaIA is a desktop application that helps you create websites, games, tools and applications with the help of an artificial intelligence. By installing or using it you accept these terms. If you do not agree, do not use it.

2. WHO CAN USE IT

To use UmbaIA you must be at least 14 years old. To take out the Pro plan you must be of legal age or have the permission of your mother, father or guardian.

3. LICENCE TO USE

We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use UmbaIA on your devices, in accordance with the plan you have. UmbaIA is not sold: it is licensed. All rights over the application belong to the owner.

4. PLANS AND PAYMENTS

  • Free plan: includes the features shown in the app (for example, one creation and one publication with the “Made with UmbaIA” badge).
  • Pro plan: monthly or yearly subscription with the extra features shown in the app. Payments are handled by our authorised reseller (Lemon Squeezy), which acts as the seller and applies its own terms and taxes.
  • Prices: 4,99 € per month or 49,90 € per year (2 months free with the yearly plan), taxes included. Occasional promotions, such as a discount on the first payment, are shown in the app and on umbaia.com and do not change the renewal price.
  • The subscription renews automatically at the end of each period, until you cancel it.
  • You can cancel the subscription whenever you want from the “Manage subscription” link you receive by email; you will keep Pro until the end of the period you have paid for and you will not be charged again.
  • If we change the price, we will tell you at least 30 days in advance and the new price will only apply from the next renewal. If you do not agree, you can cancel before then.

5. WITHDRAWAL AND REFUNDS

  • If you are a consumer, you have 14 calendar days from the purchase to withdraw without giving reasons, even if you have already started using Pro. We refund the full amount of that first payment.
  • To withdraw or ask for a refund, write to hello@imrosen.eu from the email you bought with. The refund is made by Lemon Squeezy to the same payment method.
  • Renewals are not refunded, except in the case of a charging error.

6. THIRD-PARTY SERVICES

UmbaIA works with services from other companies that you choose and that have their own terms and prices, for example:

  • The artificial intelligence provider (DeepSeek or another one you choose): you contract it and pay for it directly yourself, depending on your use. UmbaIA does not charge or see that money.
  • Netlify or Cloudflare, to publish your creations online with your own account.
  • PWABuilder (Microsoft), Google Play or Apple, if you decide to convert or publish an application.

We are not responsible for those services, their changes, their availability or their costs.

7. YOUR CREATIONS

  • What you create with UmbaIA is yours. Your files are saved on your computer.
  • You are responsible for what you create and publish: you cannot use UmbaIA to create or publish illegal or misleading content, content that infringes other people's rights, malicious content (for example, harmful programs or scam pages) or content that breaks the terms of third-party services.
  • If your creation collects data from other people (for example, a contact or booking form), you are the one responsible for processing it in accordance with the law.
  • On the Free plan, published websites carry a small “Made with UmbaIA” badge with a link to umbaia.com.

8. ARTIFICIAL INTELLIGENCE

The answers and the code generated by the artificial intelligence may contain mistakes. Check the result before using it for something important. UmbaIA asks your permission before running programs, installing things or making important changes, but the decision to allow it is yours.

9. PRIVACY

  • UmbaIA has no servers of its own that receive your conversations or your files, and it does not collect usage statistics.
  • What you write and the files needed for each task are sent directly from your device to the AI provider you have chosen.
  • When you publish, the files of your creation are sent to your Netlify or Cloudflare account.
  • If you activate a licence, your licence key and the name of your computer are sent to Lemon Squeezy, only to check it.
  • Your keys (the AI one, the Netlify or Cloudflare one and the licence one) are stored encrypted on your device.

10. RESTRICTIONS

You may not, except to the extent expressly permitted by law: copy, modify, decompile or disassemble UmbaIA; bypass its limits or its licensing system; resell, rent or redistribute it.

11. UPDATES AND CHANGES

We may improve UmbaIA and update these terms. If the changes are important, we will tell you in the app before they apply. If you do not agree, you can stop using it and cancel your subscription.

12. WARRANTIES AND LIABILITY

  • If you are a consumer, you have all the guarantees the law gives you: if Pro does not work as described, we will help you fix it and, if that is not possible, we will refund what you paid for the affected period.
  • Outside those guarantees, UmbaIA is provided as it is. Our total liability for any damage is limited to what you have paid us in the previous 12 months. We are not liable for indirect damage, such as loss of profit, nor for what third-party services do.
  • These limits do not apply if the damage is due to wilful misconduct or gross negligence on our part, or in the other cases in which the law does not allow liability to be limited.
  • We recommend making backups of your important files.

13. END OF THE AGREEMENT

You can stop using UmbaIA whenever you want. We may suspend your licence if you seriously break these terms; we will warn you first and give you the chance to explain, unless it is urgent.

14. APPLICABLE LAW AND COMPLAINTS

  • These terms are governed by Spanish law. If you are a consumer and you live in another country of the European Union, you also keep the protection given to you by the laws of your country.
  • If you have any problem, write to us first at hello@imrosen.eu: we will try to solve it within 30 days at most.
  • If you are a consumer, you may go to the courts of your place of residence.
